This contract is entered into on this _____________day of _________________, _________________ between ___________________________________________ known hereinafter as Buyer (legible copy of drivers license is required to be submitted with this contract) and Bay State Boerboels hereinafter known as Seller.

This Boerboel is, to the best of the Seller’s knowledge of sound body, good health and free of any communicable disease at the time of sale/placement. Buyer has three working days from the date of this contract to take the Boerboel to the Veterinarian of their choice. If the veterinarian finds serious illness within the first three days of ownership, this Boerboel can be returned to Seller for a replacement at the discretion of Seller. All shipping and handling costs to be born by the Buyer. Buyer must furnish a veterinary report and x-rays where applicable when requesting a replacement.. ____ ____ ____

Within one (1) year from date of purchase, should your puppy develop hip dysplasia or any other genetic disorder, which disorder will severely diminish your puppy's quality and enjoyment of life and may necessitate euthanasia, upon receipt of (1) a letter from a duly licensed veterinarian attesting to such condition and (2) a certificate of euthanasia, as well as (3) the puppy's AKC registration certificate, you will receive a replacement puppy from our next available litter. (Buyer may retain the dog if euthanasia is not necessary and all other aforementioned documentation is provided.) Seller will not be responsible for any expenses incurred on this dog's behalf. If the dog has been previously bred, the guarantee is void. Buyer is responsible for shipping costs. _____ _____ _____ (initial)

Buyer understands all monies whether applied to deposits or purchase price are not refundable regardless of circumstance. Buyer also understands all expenses related to the delivery of this Boerboel by the Seller and any return if necessary are solely the responsibility of the Buyer, due and payable to the Seller on demand._________ (initial).

Buyer understands this Boerboel was examined by a veterinarian for entropion/ectropion prior to delivery. The Buyer agrees he will receive a letter or confirmation of such exam from the veterinarian or Seller. Buyer agrees that this Boerboel’s eye status is acceptable and waives any right to seek replacement of this Boerboel for any maladies relating to entropion or ectropion. ____ ____ ____ (initial).

Buyer agrees to provide regular veterinary care, proper food, water, shelter and adequate companionship. Buyer also agrees that this Boerboel or its offspring will not be used for or sold to any pet shop, wholesale or retail outlet, dog agent or dog dealer, or dog fighting entities. ____ ____ ____ (initial).

Buyer agrees this Boerboel will only be bred to Boerboels that are AKC registered, or registered with another registry recognized by the AKC That this Boerboel before breeding will have received a vet certificate affirming the lack of entropion/ectropion. That if this is a female Boerboel she will have received a certificate from a Veterinarian affirming the lack of prolapse thru the second heat cycle. That both this Boerboel and its mate are free of dysplasia. Boerboels registered only with the USBA, and SABA are not acceptable for breeding purposes.

Buyer agrees to attend obedience class with any Boerboel purchased from Seller within six months of the date of this contract. Buyer must understand that obedience class is necessary in teaching responsible dog ownership and proper socialization of the Boerboel itself. ____ ____ ____ (initial).

If appraised, Buyer agrees to inform Seller of the appraisal score within one week of the appraisal by furnishing a legible copy of the signed appraisal scoring form. This paragraph is applicable only to countries that have appraisal venues available. This paragraph does not apply to only KUSA or AKC registered Boerboels. ____ ____ ____ (initial)

Buyer agrees and understands he/she is solely responsible for this Boerboel and to indemnify and hold harmless Seller from any and all claims of liability for the conduct of this Boerboel on or after the date of this contract. ____ ____ ____ (initial)

Buyer agrees that, if the Boerboel is male, Seller retains non exclusive breeding rights to this Boerboel at a price per total mating incident not per tie, not to exceed the original purchase price of this Boerboel. Buyer further agrees, at his own cost to obtain within 10 days of the request of the Seller both Brucellosis and Canine Herpes tests. Buyer also agrees to furnish the necessary paperwork, within 10 days of the request by Seller for the breeding if this Boerboel is the stud affirming the legitimacy of the breeding. ____ (initial)

Buyer agrees to first provide Seller with the option to purchase this Boerboel back at the original price before offering this Boerboel to any other entity or having this Boerboel put down. ____ ____ ____ (initial).

Buyer agrees that that should this Boerboel pass on (die) before age five, the Buyer will provide a veterinary certificate within 10 days as to the cause of death __________________________(initial).

Buyer agrees to notify Seller of any change of his/her address and/or telephone number within 30 days of the move. Buyer agrees to furnish Seller with regular monthly clear pictures of this Boerboel until this Boerboel reaches 18 months of age.____ ____ ____ (initial)

Buyer agrees that this Boerboel will not be involved in dog fighting, hog catching or any animal baiting sports. Buyer also agrees to pay and understands that a five-thousand dollar ($5000.00) fee will be due and payable immediately to Seller if this Boerboel is identified as participating in dog fighting, any animal baiting sports or hog catching. In addition Buyer agrees to immediately surrender this Boerboel to Seller upon demand and at the sole cost of the Buyer. ____ ____ ____ (initial).

Seller takes no contractual position regarding the training of Boerboels for Schutzhound, French Ring, Belgian Ring or other Man-Work type sports except to note that this is not in the opinion of Seller a suitable activity for the Boerboel. Further, by this statement Seller makes known to the Buyer the potential public hazard a Boerboel can become when trained to bite humans, especially when trained in a sport context as opposed to professional police or military training. . ____ ____ ____ (initial).

Buyer agrees that this Boerboel is not being purchased as a gift. The Buyer also agrees they are not acting as an agent for any other entity and that this Boerboel is intended for the buyer’s sole use and enjoyment. Buyer further agrees that this Boerboel will be living with them full time, more than 140 hours per week at the Buyer’s main place of residence._____________________ (initial).

Buyer agrees that any name he chooses for this Boerboel will be preceded with “Bay State” or "BSB" as the first two words of any name. Buyer agrees to display the full name of the dog on his website, in literature and in any other form of media that might be used to display the Boerboel. _________________(initial).

Buyer agrees that ancestry information, registration numbers, or breeding information will not be disseminated to any person or entity for display on an internet site. The buyer agrees to expressly forbid any website other than his own from displaying ancestry information on this Boerboel. The Buyer agrees to vigorously pursue and cause to desist, by any legal means any person or entity displaying information on this Boerboel without written permission from the breeder. The Buyer agrees that any action on his part does not prohibit action on the part of the breeder. The Buyer agrees that should he provide any ancestry information or permit this Boerboel to be included in any on-line pedigree website that he will immediately remit to the Seller the sum of $5000.00 US dollars. _________ (initial).

Buyer agrees to inform Seller of any and all titles earned through the AKC by this Boerboel. Proof of title must be furnished to Seller within 10 days of earning said title and Buyer agrees that seller may display photos of this Boerboel and/or proof of its accomplishments on the Sellers website, literature or media.____________________(initial).

Violation of this contract damages the goodwill and reputation of Seller and the Boerboel breed in general. Breach of any portion of this contract will result in repossession of this Boerboel without reimbursement. Such repossession may be made by the Seller or his agent, at the cost of the Buyer and is done with the full permission of the Buyer regardless of the Boerboel’s location at the time of repossession. Buyer agrees to be responsible for and compensate Seller for any damages or liabilities incurred while repossessing this Boerboel. Further any damages to Seller or to the Boerboel protected under this contract could result in both civil damages and criminal liability for the Buyer.

This contract is formed and shall be governed by the laws of the State of Massachusetts, and jurisdiction to resolve disputes rest solely in a court of competent jurisdiction in Massachusetts. Any portion of this contract deemed illegal or unconstitutional under Massachusetts law will not void any other lawful portion, of this contract according to Massachusetts law. This contract is formed with the sole intent of protecting this Boerboel and for the good of the Boerboel breed; where possible all interpretations should be made with this in mind.
